Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") are an agreement between you and Jyrax Technologies ("SafeEscort", "we", "us"), governing your use of the SafeEscort mobile app, safeescort.info and related services. By creating an account or using the service you accept these Terms and our Privacy Policy, which forms part of them. If you do not accept them, do not use SafeEscort.

2. Eligibility

You must be at least 13 years old to use SafeEscort, and old enough to form a binding contract where you live — otherwise a parent or guardian must accept these Terms on your behalf and supervise your use. You must not use SafeEscort if you are barred from doing so under applicable law.

3. Your account

• Provide accurate information when registering, and keep it current.
• You are responsible for your credentials, your app PIN, and everything done through your account.
• Tell us promptly at support@safeescort.info if you believe your account has been compromised.
• One person per account. Do not share your account with someone else.
• You may delete your account at any time from Settings inside the app.

4. Subscriptions and billing

• SafeEscort offers a free plan and paid Premium and Premium Plus plans. Current prices are shown on our pricing page and in the app.
• Paid plans are sold and billed through the Apple App Store or Google Play. Their payment terms apply, and we never receive your card details.
• Subscriptions renew automatically for the same period unless cancelled at least 24 hours before the end of the current period, in your App Store or Google Play account settings.
• Where a free trial is offered, it converts to a paid subscription at the end of the trial unless you cancel first.
• Refunds are handled by Apple or Google under their policies. We can only assist with requests, not process them. Where local consumer law gives you a withdrawal or refund right, that right applies regardless of this clause.
• We may change prices with at least 30 days’ notice. A price change never applies to a period you have already paid for.
• If you downgrade or cancel, paid features remain available until the end of the period you paid for, after which your account moves to the Free plan and its limits, including its shorter history retention.

5. Acceptable use

You agree not to:

• Use SafeEscort to track, monitor, stalk or harass anyone without their genuine, informed consent — including installing it on someone else’s device or coercing someone into adding you as an ally.
• Trigger false emergency alerts, or use the service to intimidate, threaten or defraud.
• Record audio or capture images of other people where doing so is unlawful where you are.
• Attempt to breach, probe or circumvent our security, access other users’ data, or interfere with the service.
• Reverse engineer, decompile or scrape the service, except where that restriction is prohibited by law.
• Resell, sublicense or commercially redistribute the service without our written permission.
• Use SafeEscort in breach of any applicable law, including local rules on location tracking and recording.

Serious or repeated breaches will result in suspension or termination of your account.

6. Safety features and their limits

This section is important. SafeEscort helps the people you have chosen find and reach you. It is not an emergency service and does not replace one.

• SafeEscort does not contact police, ambulance, fire services or any public emergency dispatcher on your behalf.
• Alerts depend on things outside our control: cellular and internet coverage, GPS accuracy, battery level, your device’s operating system, notification permissions, third-party push and messaging infrastructure, and whether the people you alerted see and act on the message.
• Automated features — heartbeat escalation, crash detection, geofence alerts, tracker sweeps — use heuristics and sensors. They can produce false alarms and can fail to detect a real event. Do not rely on them as your only safety measure.
• Some features run only while the app is open, and some are only available on Android or only on iOS because of platform restrictions. The app tells you which.
• Location shared under Privacy Shield is deliberately approximate, and will not identify your exact position.
• You are responsible for configuring the service in a way that suits your situation, and for keeping your allies and trusted contacts up to date.

7. Other people’s data

When you add trusted contacts, send a check-in photo, or share a chat, you may provide us with information about other people. You confirm you have the right to do so. Everyone whose location is shared through SafeEscort must have their own account and must consent to the sharing — this is enforced by the app’s mutual pairing requirement, and it must not be circumvented.

8. Intellectual property

SafeEscort, its software, design, branding and content are owned by Jyrax Technologies and protected by intellectual property law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose. All rights not expressly granted are reserved.

You keep ownership of the content you create — your messages, notes, photos, recordings and history. You grant us only the licence we need to store, process and deliver that content to the people you chose, and to operate and secure the service.

9. Disclaimer of warranties

To the fullest extent permitted by law, SafeEscort is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, timely, error-free, or that any alert will be delivered, received or acted upon.

Nothing in these Terms excludes or limits any warranty or right that cannot lawfully be excluded where you live.

10. Limitation of liability

To the fullest extent permitted by law, Jyrax Technologies and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or opportunity, arising out of or relating to your use of, or inability to use, SafeEscort — including any failure, delay or non-delivery of an alert or location update.

Our total aggregate liability arising out of or relating to the service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or fifty United States dollars (US$50).

These limits do not apply to liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or to any other liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Jyrax Technologies from any claim, damage, loss, liability or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the service, your violation of any law, or your infringement of anyone else’s rights.

12. Suspension and termination

You may stop using SafeEscort and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if continuing to provide the service to you would create a risk to others — with notice where it is practical and lawful to give it. Sections that by their nature should survive termination (ownership, disclaimers, liability, indemnity, governing law) do survive.

We may also discontinue the service or any feature, with reasonable notice, and will refund any unused prepaid subscription period if we do.

13. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law rules, and the courts of that jurisdiction have exclusive jurisdiction over any dispute — except that if you are a consumer, you keep the benefit of any mandatory protections and any right to bring proceedings in the courts of the country where you live.

Before starting formal proceedings, please contact us at support@safeescort.info — most issues can be resolved quickly and informally.

14. Changes and contact

We may update these Terms as the service develops. Material changes will be notified in the app or by email at least 30 days before they take effect, and continuing to use SafeEscort afterwards means you accept them. If you do not, you may cancel and delete your account.

If any provision of these Terms is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between us.
